Xbox 360 Forsworn Conspiracy Quest Bug

Ok, been doing this quest, got to the part where Eltrys is dead. However, when I went into the room, a high ranking Imperial tells me to join the Empire, and then walks off. The 2 Markath guards in there just stand there and do not apprehend me at all, so I'm not framed, don't get put in Cidhna mine and cannot finish it.
Tried reloading several times, entered and then left multiple times. Nothing is working.

Have you used the search function or the master list? There are tons of threads about this quest. Sorry if you have and have a unique issue.

I looked on the Master List, and all it said about this quest was guards continually attacking people after they have done the quest. I'm at the bit just before they apprehend me.
Yes I went back to the temple. The body is there but the guards just stand there. They don't even speak at all nor accuse me of committing the crime.

Someone else had this exact same problem. I would search for it for you, but i'm about to go to sleep.

i have the exact same problem it wont let me arrested the high ranking guard just says do you want to join the imperial army
