Being a Criminal unintentionally

I have a ? about gameplay. If I have a key to someone's house and sneak into it in the dark, how come that is trespassing if no one can see me? Also, how can I get charged with stealing if no one can see me?

I want to steal stuff but don't always want to be chased down by guards or bounty hunters?

Am I doing something wrong?

If you are going to steal some stuff in any particular town, go to another town to sell it. If you steal any coins then spend those coins in the same town they seem to get pissed.

At least that's what seems to be working for me.

Make sure you're in sneak mode, go into houses at around 1am (but firstly steal the keys from the owner so you can get in the house) then steal!

If all goes well, everything should seem like it has never happened!
